What is copyright?

According to the World Intellectual Property Organization (WIPO), copyright and related rights protect the rights of authors, performers, producers and broadcasters, and  contribute to the cultural and economic development of nations. This protection fulfils a decisive role in articulating the contributions and rights of different stakeholders and the relation between them and the public. The purpose of copyright and related rights is twofold: to encourage a dynamic creative culture, while returning value to creators so that they can lead a dignified economic existence, and to provide widespread, affordable access to content for the public.


The South African Copyright Act

According to the Dramatic Artistic and Literary Rights Organisation Pty Ltd (DALRO): The South African Copyright Act 98 of 1978, as amended, governs all aspects of copyright in South Africa. It sets out what is protected, from what it is protected and for how long it is protected. Copyright is territorial. For a work to be eligible for copyright protection the following must be presented:
  • Originality
  • Material must be presented in a tangible form
  • Creator must be acknowledged by SA law as a legal persona
The rights that are protected, the method of protection and even the period of protection can, and often do, differ from country to country. The principle of copyright protection is, however, common to all the nations which are signatories to the Berne Convention and the Universal Copyright Convention. The countries of the Berne Union (of which South Africa is one) are obliged to incorporate certain basic principles, or minimum standards, in their national laws and are bound to offer reciprocal treatment to works emanating from other parties to the Berne Convention.


What is fair use? 

In South Africa, the doctrine of fair dealing allows copyrighted works to be used for purposes such as criticism, news reporting, teaching, scholarship, or research. However, in an academic environment, fair use allows users to reproduce a copy, to meet reasonable needs, for their own, study, research or private use without seeking permission from the copyright owner. Multiple copies for distribution of a copyrighted work in a classroom situation does not fall within the parameters of fair use.

Who owns the copyright of my work at Stellenbosch University?
Paragraph 2.2.2 of the University's policy now reads as follows: Students assign to SU their copyrights in all works that may be created in the course of the execution of their study obligations (including all research conducted as part of such studies). These include, inter alia, all presentations, assignments, test and examination scripts, papers, dissertations, theses, sound recordings, video recordings, software, databases, designs and models developed by students in the course of their studies. In this regard, the requirements of the SU yearbook regarding the insertion of copyright notices and authorship declarations into academic materials, such as dissertations and theses, must be complied with. SU may decide in certain cases to assign ownership of the whole or part of the copyright to the student, or may authorise him or her otherwise to utilise the work commercially or otherwise.

How may I publish my research performed at Stellenbosch University?
In conformance with the SU Yearbook it should be noted that students may not publish their assignment/thesis/dissertation or a derivative version thereof in any form other than as an article in an accredited academic journal without the prior written approval of the Dean of the relevant faculty (or his delegate) unless they first publish the relevant research in one or more articles in accredited academic journals recognised for this purpose by SU and they acknowledge in such articles that the research contained therein was performed at SU. SU may, in accordance with Sections 3 and 4 of this Policy, commercially exploit patents, plant breeders’ rights and designs and related know-how emanating from a student’s assignment/ thesis/dissertation.

Wat is kopiereg?

Die Wêreldorganisasie vir Intellektuele Eiendom (WIPO) som dit soos volg op: Kopiereg en verwante regte beskerm die regte van skrywers, uitvoerende kunstenaars, vervaardigers en uitsaaiers en dra by tot die kulturele en ekonomiese ontwikkeling van nasies. Hierdie beskerming  speel 'n deurslaggewende rol in die artikulering van  die bydraes en regte van die verskillende belanghebbendes en die verhouding tussen hulle en die publiek. Die doel van kopiereg en verwante regte is tweeledig: om 'n dinamiese en kreatiewe kultuur aan te moedig, terwyl waarde aan die skeppers teruggegee word, sodat hulle 'n waardige ekonomiese bestaan kan voer, en om wydverspreide, bekostigbare toegang tot die inhoud van die skeppings vir die publiek te kan bied.


Die Suid-Afrikaanse Wet op Outeursreg

Die Dramatiese Artistieke en Literêre Regte Organisasie Edms Bpk (DALRO) stel dit soos volg: Die Suid-Afrikaanse Wet op Outeursreg 98 van 1978, soos gewysig, beheer alle aspekte van kopiereg in Suid-Afrika. Dit verduidelik  wat beskerm word, waarteen dit beskerm word en vir hoe lank dit beskerm word. Kopiereg is territoriaal. Vir 'n werk om in aanmerking te kom vir kopieregbeskerming moet die volgende beskikbaar wees:
  • Oorspronklikheid
  • Die materiaal moet in 'n tasbare vorm aangebied word
  • Die skepper moet deur die Suid-Afrikaanse reg as 'n regspersoon erken word
Die regte wat beskerm word, die wyse van beskerming en selfs die tydperk van beskerming, kan  van land tot land verskil, en dit is dan ook dikwels die geval. Al die nasies wat ondertekenaars van die Berne Konvensie en die Universele Kopiereg Konvensie is, het egter die beginsel van kopieregbeskerming met mekaar in gemeen. Die lande van die Berne Unie (waarvan Suid-Afrika een is) is verplig om sekere basiese beginsels, of minimum standaarde, in hul nasionale wetgewing te inkorporeer en is daartoe verbind om wedersydse behandeling te gee aan werke wat voortspruit uit ander partye van die Berne Konvensie.


Wat is billike gebruik?

In Suid-Afrika laat billike gebruik toe dat werke waarvan die kopiereg voorbehou word, wel gebruik kan word vir doeleindes soos kritiek, nuusverslaë, onderrig, vakgeleerdheid of navorsing. In 'n akademiese omgewing laat billike gebruik egter gebruikers toe om ‘n afskrif te maak om aan redelike behoeftes te voldoen - vir eie studie, navorsings- of private gebruik sonder die toestemming van die kopieregeienaar. Die verspreiding van veelvuldige kopieë van werke waarvan die kopiereg voorbehou word in 'n klaskamersituasie val egter nie binne die parameters van billike gebruik nie.

Wie besit die kopiereg van my werk by die Universiteit Stellenbosch?
Paragraaf 2.2.2 van die Universiteit se beleid lees nou soos volg: Studente dra hulle kopieregte op alle werke wat geskep kan word tydens die uitvoering van hulle studieverpligtinge (met inbegrip van alle navorsing wat as deel van sodanige studies uitgevoer word) aan die US oor. Dit sluit in alle aanbiedings, opdragte, toetse en eksamenantwoordboeke, werkstukke, verhandelinge, proefskrifte, klank- en videoopnames, sagteware, databasisse, ontwerpe en modelle wat deur studente ontwikkel is in die uitvoering van hul studies. In hierdie verband moet daar aan die vereistes van die US se jaarboek wat betref die invoeging van kopieregkennisgewings en outeurskapsverklarings in akademiese materiaal, byvoorbeeld verhandelinge en proefskrifte, voldoen word. Die US kan in sekere gevalle besluit om eienaarskap van die kopiereg in sy geheel of gedeeltelik aan die student oor te dra, of kan hom of haar andersins magtig om die werk kommersieel of andersins te gebruik.

Hoe kan ek my navorsing wat by die Universiteit Stellenbosch gedoen is, publiseer?
Ingevolge die Jaarboek van die Universiteit Stellenbosch kan studente nie hul werkstuk, tesis of verhandeling, of 'n afgeleide weergawe daarvan, publiseer in enige ander vorm as 'n artikel in 'n geakkrediteerde akademiese tydskrif, sonder die vooraf skriftelike goedkeuring van die Dekaan van die betrokke fakulteit (of sy gedelegeerde) nie. Al uitsondering op hierdie reël is waar die betrokke navorsing eers gepubliseer is as een of meer artikels in geakkrediteerde vaktydskrifte wat deur die Universiteit Stellenbosch  vir dié doel aanvaar word. Dit is vanselfsprekend dat die nodige erkenning in sulke artikels ook gedoen sou wees, naamlik dat die navorsing daarin vervat uitgevoer is aan die Universiteit Stellenbosch. Die Universiteit Stellenbosch kan, in ooreenstemming met artikels 3 en 4 van die beleid oor intellektuele eiendom, kommersiële patente, planttelersregte en ontwerpe en verwante kundigheid, voortspruitend uit 'n student se werkstuk, tesis of verhandeling, ontgin.
